These Terms are the agreement between you and William Falconer, doing business as Vital Animal ("Vital Animal," "we," "us," "our") for your use of my.vitalanimal.com and the courses, memberships, community and products offered through it (together, the "Service").
Please read them. By creating an account, placing an order, or using the Service, you agree to these Terms, our Privacy Policy and our Refund Policy. If you do not agree, please do not use the Service.
1. WHO CAN USE THE SERVICE
You must be at least 18 years old and able to enter into a binding contract. The Service is intended for personal, non-commercial use by animal owners and caregivers, unless we have agreed otherwise with you in writing.
2. YOUR ACCOUNT
You sign in with a link we send to your email address, so access to your email is access to your account. You agree to:
- give us accurate information and keep your email address current;
- keep your sign-in links private and not let anyone else use your account;
- tell us promptly at support@vitalanimal.com if you think someone else has accessed your account.
One account is for one person. You are responsible for activity on your account.
3. EDUCATIONAL CONTENT, NOT VETERINARY CARE
This section is important. Please read it carefully.
Everything in the Service, including courses, lessons, downloads, live sessions, recordings, emails, and anything posted in the community by us, by our team, or by other members, is general education and information only.
- It is not veterinary medical advice, diagnosis or treatment for any particular animal.
- Using the Service, taking part in a live session, or exchanging messages with us or our team does not create a veterinarian-client-patient relationship.
- It is not a substitute for an examination and care by a veterinarian who knows your animal. If your animal is ill, injured or in distress, contact a veterinarian or emergency clinic right away. Never delay seeking care because of something you read or heard here.
- Decisions about your animal's care, including vaccination, feeding, parasite prevention and treatment, are yours to make, and you are responsible for them and for their results. Discuss them with a veterinarian you trust.
- Laws on animal vaccination, including rabies vaccination, vary by location. You are responsible for knowing and following the laws that apply to you. Nothing in the Service is legal advice.
- We do not promise any particular health outcome for any animal. Results described by us or by members, including testimonials and case reports, are individual experiences and are not typical or guaranteed.
- Statements about homeopathic remedies and other products have not been evaluated by the U.S. Food and Drug Administration. These products are not intended to diagnose, treat, cure or prevent any disease.
- Content posted by other members reflects their own views and experience. We do not verify or endorse it.
4. ORDERS, PRICES AND PAYMENT
Prices are shown at checkout, in U.S. dollars unless stated otherwise. Any shipping charges and applicable taxes are shown before you pay.
Payments are processed by Stripe or PayPal. By placing an order you confirm that you are authorized to use the payment method and you authorize us to charge it for the total shown.
Your order is accepted when payment succeeds and we send your confirmation email. We may decline or cancel an order, for example where a price or description was plainly wrong, a product is no longer available, or we suspect fraud or misuse. If we cancel an order you have paid for, we will refund it in full.
If we offer you an additional product immediately after your purchase and you choose to accept it, you authorize us to charge the payment method you just used for the price shown on that offer.
If you choose an installment plan, you agree to pay every installment on schedule. If a payment fails and is not corrected, we may suspend access until the plan is brought up to date.
Please check your confirmation email and tell us promptly about any mistake.
5. SUBSCRIPTIONS AND AUTOMATIC RENEWAL
Some products, including the Vital Animal Alpha membership, are sold as subscriptions.
- Automatic renewal. A subscription renews automatically at the end of each billing period (monthly or yearly, as you chose at checkout), and we charge your payment method the price shown at checkout for each new period, until you cancel.
- How to cancel. You can cancel at any time. Sign in at my.vitalanimal.com, open your Account page, and cancel the subscription there. If your subscription shows as managed outside the site, or you have any trouble, email support@vitalanimal.com and we will cancel it for you.
- When to cancel. To avoid being charged for the next period, cancel before your renewal date. Your renewal date is shown on your Account page.
- What happens after you cancel. You keep access until the end of the period you have already paid for. After that, your access to the membership's lessons, live sessions and discussion spaces ends, and you are not charged again.
- Price changes. If we change the price of your subscription, we will email you at least 30 days before the new price applies. If you do not want to continue at the new price, cancel before it takes effect.
- Failed payments. If a renewal payment fails, we may try the charge again and may suspend or end your access if it remains unpaid.
- Refunds. Subscription payments, including the first payment and all renewal payments, are not refundable. See the Refund Policy for details.
6. REFUNDS
Our Refund Policy at my.vitalanimal.com/legal/refunds explains when you can get a refund and how to ask for one. It is part of these Terms.
7. PHYSICAL PRODUCTS
Homeopathic remedies and other physical products are prepared and shipped by an independent pharmacy, to addresses in the United States and Canada only. To fulfil your order we give the pharmacy your name, shipping address and order details.
Delivery times are estimates. Outside the United States, you are responsible for any customs duties, import taxes and for making sure the product may lawfully be imported to your address.
Use physical products according to Dr. Falconer's protocols, which are provided on our website or inside the related course. These protocols may differ from the directions printed on the product label. Keep all products out of the reach of children. See the Refund Policy for returns.
8. YOUR ACCESS TO COURSES AND CONTENT
When you buy a course or membership, we give you a personal, limited, non-exclusive, non-transferable right to access and view its content through the Service for your own non-commercial use. You are buying access, not ownership of the content.
For one-time course purchases, access lasts for as long as we offer that course through the Service. If we ever retire a course you have bought, we will make reasonable efforts to tell you in advance by email so you can finish it. For memberships, access lasts while your subscription is active.
We may update, reorganize, add to or remove content and features over time. Live sessions may be rescheduled or cancelled. If we cancel a live session, we will try to reschedule it or provide a recording or equivalent.
You agree not to:
- share your account, or give anyone else access to paid content;
- copy, record, download (except files we offer for download), republish, resell, distribute or publicly show any content;
- use the content to create or deliver a competing course, product or service, or use it in professional practice or teaching without our written permission;
- use any automated means to scrape, harvest or copy the Service, or use its content to train or develop software or artificial intelligence models;
- attempt to get around access controls or payment, or interfere with the security or operation of the Service.
Files we provide for download are for your own personal use only.
9. COMMUNITY AND THINGS YOU POST
The Service includes comment areas, discussion spaces, events and other places where members can post ("Member Content"). You are responsible for what you post.
You agree not to post anything that:
- is unlawful, harassing, threatening, hateful, defamatory, obscene or deceptive;
- infringes someone else's copyright, trademark, privacy or other rights;
- shares another person's private information without their permission;
- is spam, advertising, solicitation or promotion of your own products or services without our permission;
- impersonates another person or misrepresents your qualifications;
- contains malware or is meant to disrupt the Service.
Please treat other members with respect, and keep what other members share in private spaces within those spaces.
You keep ownership of your Member Content. You give us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display and distribute it within the Service, so that the Service can work and other members can see what you post. This license continues for content that remains part of a discussion after your account closes, so that conversations stay readable. We will not use your Member Content in our public marketing without asking you first.
We may, but are not obliged to, review, edit, hide or remove Member Content, and we may restrict or end a member's ability to post, where we believe these Terms have been broken or it is needed to protect members or the Service.
Live sessions may be recorded and made available to other members. If you take part by voice, video or chat, you consent to being included in the recording.
If you send us feedback or suggestions, we may use them without any obligation to you.
10. OUR INTELLECTUAL PROPERTY
The Service and its content, including text, videos, audio, images, downloads, course structure, logos and the Vital Animal name, are owned by us or our licensors and are protected by copyright, trademark and other laws. Vital Animal is a registered trademark. Except for the limited access described in Section 8, these Terms give you no rights in any of it.
11. COPYRIGHT COMPLAINTS
If you believe something on the Service infringes your copyright, email support@vitalanimal.com with: a description of the copyrighted work; where the material appears on the Service; your name, address, phone number and email; a statement that you believe in good faith the use is not authorized by the copyright owner, its agent or the law; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We may remove the material and, where appropriate, end the accounts of repeat infringers.
12. THIRD-PARTY SERVICES AND LINKS
The Service relies on and may link to services run by others, such as payment processors, video hosting and outside websites. We are not responsible for their content, products or practices, and your use of them is governed by their own terms.
13. SUSPENSION AND TERMINATION
You may stop using the Service at any time. To close your account, email support@vitalanimal.com. Closing your account does not by itself cancel a subscription or entitle you to a refund; cancel subscriptions as described in Section 5.
We may suspend or end your access, without refund, if you seriously or repeatedly break these Terms, for example by sharing or copying paid content, abusing other members, or acting fraudulently. Where the issue can reasonably be fixed, we will try to warn you first.
If we end your access for a reason other than your breach of these Terms, we will refund any prepaid subscription fees for the unused part of your current period, and for a one-time purchase made in the previous 30 days, the purchase price.
Sections that by their nature should continue after termination, including Sections 3, 9 (license), 10, and 14 to 18, will continue to apply.
14. DISCLAIMER OF WARRANTIES
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE CONTENT IS ACCURATE, COMPLETE OR CURRENT, THAT IT IS SUITABLE FOR YOUR ANIMAL, THAT IT WILL PRODUCE ANY PARTICULAR RESULT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.
Our money-back guarantee is described in the Refund Policy and is your remedy if you are not satisfied with a purchase. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
15. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW:
(A) WE, AND OUR OWNERS, EMPLOYEES, CONTRACTORS AND AGENTS, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, OR FOR ANY INJURY, ILLNESS OR DEATH OF AN ANIMAL OR VETERINARY EXPENSES, ARISING FROM OR RELATED TO THE SERVICE, ITS CONTENT, OR YOUR RELIANCE ON EITHER, WHATEVER THE LEGAL THEORY AND EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES ARE POSSIBLE; AND
(B) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (II) US $100.
These limits do not apply to liability that cannot be limited by law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
16. INDEMNITY
To the extent permitted by law, you agree to defend, indemnify and hold us harmless from claims, losses and reasonable costs (including attorneys' fees) brought by a third party and arising from your Member Content, your misuse of the Service, or your breach of these Terms or of the law.
17. GOVERNING LAW AND DISPUTES
Talk to us first. Most concerns can be resolved quickly by emailing support@vitalanimal.com. Before starting any legal proceeding, you and we each agree to give the other written notice of the dispute and 30 days to try to resolve it informally.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Travis County, Texas, and you and we consent to the jurisdiction of those courts. Either of us may instead bring an individual claim in a small claims court that has jurisdiction.
If you are a consumer living outside the United States, you may also have the benefit of mandatory protections under the law of the country where you live, and nothing here removes them.
18. GENERAL
Changes to these Terms. We may update these Terms. If a change is significant, we will tell you by email or by a notice on the Service before it takes effect. Changes do not apply to disputes that arose before the change. If you keep using the Service after a change takes effect, you accept the updated Terms. If you do not agree, stop using the Service and cancel any subscription.
Entire agreement. These Terms, the Privacy Policy, the Refund Policy and the terms shown at checkout for your purchase are the whole agreement between you and us about the Service. If a product page or checkout states specific terms for that product, those specific terms apply to that product.
Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
No waiver. If we do not enforce a provision, that is not a waiver of our right to do so later.
Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor or to a buyer of our business, and your rights will not be reduced as a result.
Events outside our control. We are not responsible for delay or failure caused by events beyond our reasonable control.
Notices. We may send you notices at the email address on your account. Send legal notices to us at the address below, with a copy by email.
